1. General Provisions
These General Terms and Conditions ("T&C") govern the contractual relationship between BeMyBestGuide ("we", "us", "the outdoor guide") and persons registering for outdoor tours and activities ("participant", "you") via the platform at https://bemybestguide.com.
By submitting a registration, you acknowledge that you have read, understood, and agree to be bound by these T&C in their entirety. If you do not agree, you must not register.
These T&C are governed by Swiss law, specifically the Swiss Code of Obligations (OR/CO). The exclusive place of jurisdiction for any disputes arising from or related to these T&C is the Canton of Vaud, Switzerland, unless mandatory statutory provisions specify otherwise.
2. Registration & Booking
A booking is initiated when the participant completes and submits the online registration form. The booking is not confirmed until the outdoor guide expressly approves the registration and the participant receives a written confirmation email.
The outdoor guide reserves the right to refuse any registration without giving reasons, in particular if:
- the maximum participant capacity has been reached;
- the participant does not meet the required fitness level or prerequisites;
- the participant has previously violated these T&C.
All prices are stated in Swiss Francs (CHF) and are per person unless otherwise indicated. Prices include VAT where applicable under Swiss law.
3. Payment
Payment is due upon receipt of the confirmation email, unless a specific deadline is stated. Payment must be made by bank transfer to the outdoor guide's account details provided in the confirmation email, using the booking reference (event code) as the payment description.
If payment is not received within 5 days of the confirmation, the outdoor guide reserves the right to cancel the registration.
To ensure fair availability for all participants, pending reservations may expire automatically after 5 days if no payment is received.
A PDF invoice will be issued by the outdoor guide upon confirmation of payment receipt. The invoice serves as proof of payment and must be retained by the participant.
4. Cancellation & Refunds
Cancellation by the participant:
- More than a month before the event: Full refund & no administration fee.
- More than 14 days before the event: Full refund minus a CHF 20 administration fee.
- 8–14 days before the event: 50% refund of the total price paid.
- 7 days or fewer before the event: No refund. The full amount is forfeited.
- No-show: No refund under any circumstances.
Cancellation by the outdoor guide:
We reserve the right to cancel or reschedule events due to:
- Adverse or dangerous weather conditions (including but not limited to avalanche risk, thunderstorms, high winds, or poor visibility);
- Insufficient participant numbers (minimum group size not reached);
- Outdoor guide illness, injury, or force majeure events.
In the event of outdoor guide-initiated cancellation, participants will receive a full refund or the option to transfer their booking to another event. The outdoor guide is not liable for any incidental costs (travel, accommodation, equipment) incurred by participants.
5. Health, Fitness & Prerequisites
Mountain and outdoor activities carry inherent physical demands. By registering, you confirm that:
- You are in good health and have no medical conditions that would prevent safe participation;
- You possess the fitness level, experience, and equipment appropriate for the stated difficulty level;
- You have disclosed any relevant medical conditions, allergies, or physical limitations in the registration form;
- You are not under the influence of alcohol, drugs, or any substance impairing judgment or physical ability.
Participants with pre-existing heart conditions, respiratory illnesses, epilepsy, or other conditions that may be aggravated by physical exertion or altitude must obtain written medical clearance before registering and present it to the outdoor guide upon request.
The outdoor guide retains the right to refuse participation or remove a participant from an ongoing activity if, in their professional judgment, the participant's health or fitness poses a risk to themselves or others. No refund will be issued in such cases.
Participants under the age of 18 must be accompanied by a parent or legal guardian, or present written parental consent.
6. Liability & Risk Assumption
Outdoor mountain activities involve inherent risks including but not limited to: falls, rockfalls, avalanches, sudden weather changes, hypothermia, altitude sickness, animal encounters, and equipment failure. By participating, you voluntarily assume all such inherent risks.
The outdoor guide:
- Is not liable for injury, illness, death, loss of or damage to property arising from participation, except in cases of gross negligence or willful misconduct;
- Is not responsible for force majeure events (natural disasters, acts of government, pandemics, etc.);
- Is not liable for any personal items lost, stolen, or damaged during the activity.
Liability is limited to the amount paid by the participant for the specific activity in question, to the extent permitted by Swiss law.
7. Insurance
Participants are strongly recommended to hold appropriate insurance coverage, including:
- Mountain rescue insurance (e.g. REGA or Alpine Clubs — CAS/SAC membership);
- Personal accident insurance covering outdoor sports activities;
- Travel cancellation insurance for international participants.
The outdoor guide does not provide insurance coverage for participants. Costs of mountain rescue, medical evacuation, and hospitalisation are the sole responsibility of the participant.
8. Conduct & Guide Authority
The outdoor guide's decisions in the field are final and binding for safety and operational reasons. Participants must:
- Follow all instructions given by the outdoor guide without delay;
- Respect other participants, the outdoor guide, and the natural environment;
- Not deviate from the group or the planned route without the outdoor guide's explicit permission;
- Carry adequate food, water, and clothing appropriate for mountain conditions;
- Inform the outdoor guide immediately of any physical discomfort, injury, or equipment failure.
The outdoor guide may terminate a participant's participation without refund if the participant endangers themselves or others, violates these T&C, or engages in abusive, threatening, or disruptive behaviour.
Group Coordination & Responsibility
To ensure the safety, coordination, and overall experience of the group, participants are expected to remain within agreed meeting points and follow the guidance of the outdoor guide throughout the event.
If a participant or subgroup leaves voluntarily the agreed route, meeting point, or group without prior coordination and does not return within 15 minutes after the agreed time, the outdoor guide may attempt one reasonable reconnection attempt (for example by phone, if possible and network coverage is available).
If reconnection is unsuccessful, and the missing participant/subgroup is not considered to be in immediate danger, the outdoor guide reserves the right to continue the tour with the remaining participants in the interest of group safety, timing, weather conditions, and overall logistics.
In such cases, no refund, compensation, or complaint claim can be accepted for the participant(s) who separated from the group.
By confirming and participating in the guided event, participants acknowledge that they have read, understood, and accepted this policy.
9. Environmental Responsibility
We are committed to sustainable and responsible outdoor tourism. Participants must:
- Leave no trace — carry out all waste;
- Stay on marked trails and designated routes;
- Respect wildlife and protected flora;
- Observe all local regulations, national park rules, and Swiss federal environmental laws.
10. Data Protection (GDPR / nDSG)
The outdoor guide processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Swiss New Federal Act on Data Protection (nDSG / revDSG, in force September 2023).
Data collected and purpose:
- Name, email, phone — for booking administration and communication;
- Emergency contact — for safety purposes only;
- Payment reference — for invoice issuance;
- Activity history — for loyalty points tracking within the platform.
Data is stored in the European Economic Area (EEA) using Supabase (PostgreSQL). Data is not sold to third parties. Email communications are sent via Resend (a US-based provider with EU data processing agreement).
You have the right to access, correct, delete, and port your personal data. To exercise these rights, contact us at bemybestguide@gmail.com. Account deletion can be self-serviced from your account settings.
Data is retained for the duration of your account and for 10 years thereafter for tax/invoice purposes, in line with Swiss accounting law.
11. Intellectual Property
All content on this platform — including text, images, logos, and software — is the property of BeMyBestGuide or its licensors and is protected by Swiss and international copyright law. Reproduction or distribution without written permission is prohibited.
12. Amendments
The outdoor guide reserves the right to amend these T&C at any time. The current version is always available at https://bemybestguide.com/terms. Registered users will be notified of material changes by email. Continued use of the platform after notification constitutes acceptance of the amended T&C.
